1. Acceptance of Terms & Eligibility
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "User," or "You") and DRIVANA ("Company," "we," "us," or "our"), governing your access to and use of dripwithdrivana.com, as well as all at-home, on-demand mobile intravenous (IV) hydration sessions, aesthetic rituals, wellness consultations, The Reliable NutrAid educational programs, and apothecary products delivered across Bangalore, Karnataka, India.
Age & Capacity: By scheduling an appointment or using this platform, you explicitly represent and warrant that you are at least 18 years of age, possess full legal capacity to enter into binding contracts, and are not under any legal disability under the Indian Contract Act, 1872.
If you do not agree unconditionally to all provisions contained herein, you must immediately refrain from booking any DRIVANA service or accessing this platform.
2. Critical Medical Disclaimer & Non-Emergency Notice
DRIVANA provides elective wellness, nutritional supplementation, and aesthetic concierge services. We are NOT an emergency medical facility, acute trauma center, or ambulance service. If you are experiencing acute chest pain, severe shortness of breath, sudden neurological symptoms, severe allergic anaphylaxis, acute trauma, or any life-threatening medical condition, IMMEDIATELY CALL 112 / 108 OR PROCEED TO THE NEAREST HOSPITAL EMERGENCY DEPARTMENT.
- Wellness & Nutritional Focus: Intravenous drips and formulations offered by DRIVANA are formulated for hydration, nutritional replenishment, recovery, athletic support, and aesthetic radiance. Statements and treatments have not been evaluated as a substitute for primary medical diagnosis or comprehensive clinical care for chronic or acute pathologies.
- No Substitute for Primary Physician Care: Our services do not replace your regular relationship with your primary care physician, oncologist, cardiologist, or nephrologist. Always consult your treating doctor regarding chronic medical conditions or medication interactions.
3. Mandatory Health Disclosure & Informed Consent
The safety and clinical efficacy of your intravenous session depend strictly upon the complete and truthful disclosure of your medical history:
A. Obligation of Complete Truthfulness
You agree and certify under legal oath to disclose all current medications, dietary supplements, known allergies (especially to vitamins, sulfa compounds, or anesthetic agents), past medical diagnoses, history of kidney/renal impairment, congestive heart failure, liver dysfunction, uncontrolled hypertension, G6PD deficiency, active pregnancy or lactation, and recent surgeries.
B. Absolute Release for Non-Disclosure
DRIVANA, its medical directors, prescribing physicians, registered nurses, and affiliates are completely and unconditionally released from any liability, injury, or adverse consequence arising directly or indirectly from your omission, concealment, or misrepresentation of medical information.
C. Clinician's Right to Refuse or Abort
Our registered nurses and consulting physicians retain the absolute, unappealable professional discretion to refuse, modify, or immediately abort any intravenous administration if abnormal vital signs are detected, clinical contraindications emerge, or if the client appears intoxicated, under the influence of illicit substances, or uncooperative.
4. Acknowledgement of Procedural IV & Venipuncture Risks
Although all DRIVANA procedures are performed by certified, licensed registered nurses utilizing sterile, single-use, hospital-grade medical consumables, you acknowledge that all intravenous (IV) and intramuscular (IM) procedures carry intrinsic physiological risks, which include but are not limited to:
By consenting to treatment, you voluntarily assume all known and customary risks associated with venipuncture and vitamin infusions administered under standard clinical protocols.
5. Bookings, Nurse Dispatch & Cancellation Policy
DRIVANA operates a dedicated clinical mobile dispatch service across Bangalore. To respect our healthcare personnel’s scheduling and logistics:
- Advance Notice: We request cancellations or rescheduling at least 3 hours prior to the scheduled appointment time.
- Late Cancellation & Nurse en Route: If a booking is cancelled after our registered nurse has been dispatched or within 2 hours of the scheduled slot, a nominal clinical dispatch/travel fee of ₹500 may be levied to compensate the visiting clinician.
- No-Shows & Clinical Refusal for Intoxication: If a client is absent at the provided location or if the nurse is forced to abort due to client intoxication or abusive behavior, the session will be treated as rendered and non-refundable.
6. Safe Environment & Zero Tolerance Policy
The safety, dignity, and professional security of our clinical nurses and medical staff are paramount:
- Clients agree to provide a clean, well-lit, hygienic, well-ventilated, and safe domestic or office environment for the visiting healthcare professional.
- Zero Tolerance for Harassment: Any verbal abuse, physical intimidation, sexual harassment, or illicit behavior directed at DRIVANA personnel will result in immediate termination of the appointment without refund, and mandatory reporting to Bangalore Law Enforcement Authorities.
7. The Reliable NutrAid & Educational Courses Disclaimer
All educational modules, clinical nutrition courses, public health practice roadmaps, research frameworks, and certificates provided through The Reliable NutrAid platform are structured exclusively for professional development, academic enrichment, and skill enhancement:
- Completion of any course or certificate does NOT confer a statutory medical license, dietetic board registration, or independent clinical diagnosis authority where local legislation mandates state licensing.
- Participants are individually responsible for operating within their respective professional scope of practice and legal jurisdictions.
8. Apothecary & Skincare Homecare Products
Topical serums, hair recovery solutions, and nutritional supplements purchased through DRIVANA should be used strictly according to packaging directions. Always conduct a 24-hour patch test before full topical application. If irritation occurs, discontinue use immediately.
9. Comprehensive Limitation of Liability & Indemnity
EXCLUSION OF CONSEQUENTIAL DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DRIVANA, ITS FOUNDERS, DIRECTORS, INVESTORS, EMPLOYEES, CONSULTING PHYSICIANS, REGISTERED NURSES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, BUSINESS INTERRUPTION, OR PERSONAL DISTRESS) ARISING OUT OF OR IN CONNECTION WITH THE USE OF OUR SERVICES, WEBSITE, OR PRODUCTS.
MAXIMUM AGGREGATE LIABILITY: DRIVANA’S TOTAL CUMULATIVE LIABILITY ARISING UNDER OR IN CONNECTION WITH ANY TRANSACTION SHALL BE STRICTLY LIMITED TO THE EXACT AMOUNT ACTUALLY PAID BY YOU TO DRIVANA FOR THE SPECIFIC APPOINTMENT OR PRODUCT UNDERLYING THE CLAIM.
Indemnification: You agree to defend, indemnify, and hold harmless DRIVANA, its officers, medical practitioners, and registered nurses against any claims, damages, losses, liabilities, costs, and legal fees arising from your breach of these Terms, your failure to provide accurate medical history, or your violation of any applicable law.
10. Governing Law & Exclusive Bangalore Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to DRIVANA’s services shall be governed by and construed in accordance with the substantive laws of the Republic of India, without regard to conflict of law principles.
Any legal proceedings, suits, or arbitral actions shall be subject to the exclusive jurisdiction of the competent Courts situated in Bengaluru (Bangalore), Karnataka, India.
